Full Legal Notice Regarding Wireless and Telegraphy Act,
1949
DISCLAIMER
The
Purchaser indemnifies the Company (i-magine) against all
liabilities in respect of any matter arising out of or
in the Purchase Agreement. The Company shall not be
liable for any loss, damage, claim or expense arising
out of, or in connection with, the Purchase Agreement.
The Purchaser shall indemnify the Company against all
losses, claims, damages and expenses suffered by the
Purchaser: (i) arising out of the purchase of the
product (ii) as a result of any breach of warranty of
the product (iii) as a result any legal proceedings
against the Purchaser on account of the purchase of the
product.
All
warranties, terms and conditions whether expressed or
implied by statute or otherwise except for those
especially set out in this Purchase Agreement are
excluded and in no circumstances shall the Company be
liable to the Purchaser for any loss or damage arising
out of or relating to the purchase of the product
whatsoever which: i) is indirect or consequential; and
ii) arising through negligence misrepresentation breach
of any statutory duty or any conditions or warranty
implied by law regarding the product. The Purchaser
warrants that the use of the product will not violate
any law regulation or treaties and that such use will
not be in breach of the intellectual property rights or
licensing laws of the UK. The Purchaser warrants that
the use of the product may only be for lawful purposes
and that the Purchaser shall not use or authorise or
permit anyone else to use the product for any use which
is prohibited by UK Law. The Purchaser shall indemnify
and hold indemnified the company against all claims
liabilities losses damages costs and expenses incurred
or suffered by the Company (including but not limited to
claims in respect of differential breach of copyright or
other intellectual property right infringement) by
reason of a breach by the Purchaser or any of the
Purchaser’s obligations set out in the Purchase
Agreement. Except expressively provided in the Purchase
Agreement and to the extent permitted by UK Law the
Company excludes all liability whether in contract tort
(including liability for negligence) or otherwise for
the accuracy suitability or the quality of the product.
The
Purchaser hereby acknowledges that he has not purchased
the product upon reliance on any written or implied
representation or warranties given by the Company or any
other person acting or purporting to act on the
Company’s behalf. The Purchaser warrants that the
Purchaser has not relied on any representation made by
the Company or upon any discretion, illustrations or
specifications contained in any catalogues or publicity
material. The Purchaser warrants that it shall comply in
all material respects with all applicable Laws,
Regulations or Codes of Conduct Practice (whether
statutory or otherwise) of the UK and that all licences
permissions all concerns required for using of the
Product have been obtained and are in full force and
effect. Any Purchaser or prospective Purchaser or any
person interested in the product must first satisfy him
or herself of the suitability use permit of use and all
other prerequisite regarding the product prior to the
purchase of the product from the Company. We will not
knowingly sell this product to customers in the UK or
EU, or to customers who intend to use this product
within the UK or EU. The Company is
in no way responsible for the actions and inactions of
the Purchaser regarding the product purchased from the
Company. The Company disclaims any liability loss damage
expense on account of the purchase. This Disclaimer
forms part of the Purchase Agreement regarding the
product. A Purchaser of the product agrees therefore to
be bound by and adhere to the terms of the Purchase
Agreement.
